Platform Availability and Local Requirements

Givee® is designed to support registered entities and users across different markets, subject to platform availability, payment-provider support, verification requirements, communications-provider coverage, operational feasibility, risk review and applicable law.

Not all features are available in every country, region, entity type or use case. Features such as payment processing, digital raffles, prize draws, promotional games, SMS, email, receipts, devices, integrations, tax receipting and volunteer functionality may be limited, modified or unavailable depending on local laws, payment-provider requirements, communications-provider coverage, regulatory restrictions or operational feasibility.

Registered entities are responsible for determining whether their use of Givee® is lawful in their own country, state, province, territory or region. This includes responsibility for fundraising, customer payments, raffles, prize draws, promotions, tax, receipting, privacy, consumer protection, electronic communications, anti-spam, sanctions, licensing and operational obligations.

Givee® may refuse, restrict, suspend or discontinue access in any market, region or use case where Givee® reasonably considers that use may create legal, regulatory, security, operational, payment-provider or reputational risk.

Terms of Service

1. Acceptance of Terms

By accessing or using Givee®, you agree to these Terms of Service. If you do not agree, you should not use Givee®.

2. Who may use Givee®

Givee® may be used by registered entities and users approved or permitted to access the platform. Registered entities may include businesses, charities, non-profits, schools, places of worship, government bodies, event operators, sole traders, community organisations and other approved entities.

Users may include customers, donors, supporters, purchasers, raffle participants, prize draw participants, volunteers, entity administrators, team members, staff, visitors and other people who access or interact with Givee®. Givee® may require identity, entity, payment-provider, business, compliance, sanctions, risk or other verification checks before enabling access to some features.

3. Licence to use the platform

Subject to these Terms, Givee® grants approved registered entities and users a limited, non-exclusive, non-transferable and revocable licence to access and use Givee® for lawful purposes. All rights in the Givee® platform, technology, software, interfaces, workflows, systems, trade marks, designs, content, configuration, analytics, documentation and related intellectual property remain owned by Giving Intelligence Pty Ltd or its licensors.

4. Account registration and access

You must provide accurate, current and complete information when creating or maintaining an account. You are responsible for maintaining the security of your devices, email inboxes, mobile numbers, authorised access channels and account access.

Givee® may use passwordless authentication, including SMS or email one-time passcodes. Givee® does not store user passwords for passwordless authentication flows.

Givee® may suspend or restrict access where it reasonably suspects misuse, unauthorised access, fraud, security risk, unlawful activity, breach of these Terms, breach of applicable law, breach of payment-provider requirements, sanctions risk or failure to satisfy verification requirements.

5. Registered entity responsibilities

  • their own legal, regulatory, tax, customer, supporter, payment, fundraising, raffle, prize draw, promotional game, communications and operational obligations
  • ensuring information provided to Givee® is accurate and up to date
  • managing authorised users and role-based access
  • ensuring campaigns, flows, offers, payments, raffles, promotions, messages and content are lawful and not misleading
  • obtaining any required permits, approvals, licences, registrations or consents
  • complying with applicable privacy, data protection, anti-spam, consumer, fundraising, raffle, gaming, tax, sanctions, anti-money laundering and payment-provider requirements
  • handling exported data lawfully and securely

6. User responsibilities

Users must not misuse Givee® or use Givee® for unlawful, fraudulent, misleading, harmful, abusive, offensive, unauthorised or non-compliant activity. Users are responsible for the accuracy of information they provide and for complying with applicable laws when participating in transactions, raffles, prize draws, campaigns, volunteer activities, advocacy tools or communications.

7. Platform fees and pricing

Givee® charges a baseline platform fee on successful transactions processed through the platform. There are no mandatory setup fees, monthly fees or annual fees for core access unless separately agreed in writing or disclosed for a specific activated service.

Givee® may charge a higher platform fee where additional services, managed infrastructure, device-supported flows or other enhanced services are activated. Stripe or other payment-provider fees are separate from Givee® platform fees and are not set or controlled by Givee®.

Givee® may change platform fees or its cost model by providing at least three months' notice by email to the registered entity's nominated contact, unless a shorter period is required by law, payment-provider change, regulatory requirement or urgent operational necessity.

8. Payment processing

Givee® integrates with Stripe and may integrate with other approved payment providers over time. Payments facilitated through Givee® are processed by the relevant payment provider. Givee® does not directly store payment card details.

Where Stripe is used, Givee® may use Stripe Connect and Direct Charges or similar payment-provider functionality so that transactions are processed through the registered entity's connected payment-provider account. Payments facilitated through Givee® are visible within the organisation's Stripe dashboard, subject to Stripe settings, Stripe availability and payment-provider processing rules.

The total transaction amount may be processed to the registered entity's connected Stripe account, with Givee®'s platform fee processed through Stripe according to the applicable configuration. Stripe then applies its own processing fees according to the entity's Stripe terms.

Givee® may allow entities to configure whether Givee® platform fees or additional fees are absorbed by the entity or passed on to the customer where supported by the platform and permitted by law. Givee® expects to continue exploring additional payment-provider integrations where commercially and technically feasible.

9. Refunds, disputes and chargebacks

Refunds, disputes, chargebacks, cancellations and adjustments may be handled by the registered entity, the payment provider and/or Givee® depending on the transaction type, payment-provider rules, applicable law and platform capability. Givee® is not responsible for refunding funds it does not hold, except to the extent required by law or expressly agreed in writing.

10. Raffles, prize draws and promotional games

Givee® may provide technology tools that assist registered entities to configure, manage or support raffles, prize draws, lotteries, trade promotions, sweepstakes or other promotional game activities where available.

Registered entities are solely responsible for ensuring that raffle, lottery, gaming, sweepstakes, trade promotion, prize, ticketing and promotional game activities comply with all applicable laws, permits, eligibility rules, prize disclosures, draw requirements, jurisdictional restrictions and ethical obligations.

Givee® does not operate raffles, lotteries, sweepstakes or promotional games on behalf of registered entities unless expressly agreed in writing. Givee® may suspend, restrict or remove raffle-related or promotional-game-related access where misuse, legal risk, non-compliance or suspected unlawful activity is identified.

11. Communications

Givee® may support SMS, email, OTP, receipt, notification, thank-you, reporting and other communication workflows. Registered entities are responsible for ensuring their communications comply with applicable privacy, data protection, anti-spam, consent, unsubscribe, customer, supporter and electronic messaging laws in the countries or regions where recipients are located.

Givee® may provide communication tooling and infrastructure, but registered entities remain responsible for the content, purpose, lawfulness and recipient basis of communications they send or enable.

12. Device and managed infrastructure

Givee® may provide, manage or support devices and hardware used with the platform. Unless expressly agreed otherwise, outright device sales are not the standard Givee® operating model. Devices may remain Givee®-managed infrastructure.

Registered entities are responsible for safe, lawful and secure use of devices, including device storage, supervision, loss prevention, connectivity, physical security and use in accordance with applicable laws and Givee® instructions. Givee® may recall, replace, disable, update or reconfigure devices where required for security, support, compliance, operational or platform reasons.

13. Generated content and advocacy tools

Some Givee® features may allow users or entities to generate personalised messages, advocacy letters, campaign messages or other content. Generated content may be dynamically created based on user or entity inputs. Givee® does not guarantee that generated content is legally compliant, factually complete, suitable for a particular purpose, or appropriate for every recipient or jurisdiction.

Users and entities are responsible for reviewing and approving generated content before using, sending or publishing it.

14. Third-party services

Givee® may integrate with third-party providers, including payment providers, communication providers, cloud hosting providers, analytics providers, monitoring providers, CRM systems, fundraising platforms and other operational service providers. Givee® is not responsible for the availability, performance, security, acts, omissions, fees, policies or terms of third-party providers, except to the extent required by law.

15. Service availability

Givee® aims to provide reliable platform access, but does not guarantee uninterrupted, error-free or continuous availability. Platform access may be affected by maintenance, outages, incidents, third-party provider issues, security actions, device issues, network availability, payment-provider downtime or events outside Givee®'s reasonable control.

16. Suspension and termination

Givee® may suspend, restrict or terminate access where it reasonably considers that these Terms have been breached, verification requirements are not satisfied, fraud or misuse is suspected, payment-provider requirements are not met, required information is inaccurate or incomplete, or continued access may create legal, regulatory, operational, security, sanctions, payment-provider or reputational risk.

Users may stop using Givee® at any time. Registered entities may request account closure, subject to legal, operational, payment, audit, tax, raffle, dispute and data-retention requirements.

17. Liability

To the maximum extent permitted by law, Givee® is not liable for indirect, consequential, special, incidental, exemplary or punitive loss, loss of profit, loss of revenue, loss of goodwill, loss of opportunity, loss of data, lost donations, failed campaigns, reputational damage, regulatory penalties caused by entity conduct, third-party service failures, payment-provider issues, device misuse or non-compliant use of the platform.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot be excluded, restricted or modified under applicable law.

18. Liability cap

To the maximum extent permitted by law, Givee®'s total aggregate liability arising out of or relating to the platform, these Terms or any related policy is limited to AUD $1,000 or the equivalent amount in local currency at the time of the claim, unless a different limit is expressly agreed in writing. This cap does not apply to liability that cannot be limited under applicable law.

19. Indemnity

To the maximum extent permitted by law, registered entities and users indemnify Giving Intelligence Pty Ltd against claims, losses, liabilities, costs and expenses arising from misuse of Givee®, unlawful activity, breach of these Terms, non-compliant campaigns, raffle misuse, promotional game misuse, payment disputes caused by entity conduct, privacy or data protection breaches caused by exported data handling, unauthorised communications, misleading content or breach of applicable laws.

20. Governing law

These Terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.

Nothing in this section limits any non-excludable consumer, privacy, data protection or other rights that may apply in the country or region where a user or entity is located.

Privacy Policy

1. Purpose

This Privacy Policy explains how Giving Intelligence Pty Ltd collects, uses, stores, discloses and protects personal information through Givee®. Where Givee® is used in different countries or regions, local privacy, data protection, consumer and electronic communications laws may apply.

2. Information we collect

  • name, email address, mobile number, country, state/region and timezone
  • customer, donor, supporter, purchaser, volunteer or participant details
  • transaction records, receipt details, campaign, flow, raffle, prize draw and participation records
  • communication preferences and communication records
  • entity administrator and user account details
  • device, browser and usage data
  • support, security and audit records
  • information provided through forms, dashboards, apps, devices, integrations or communications

Payment card details are processed by Stripe or another approved payment provider and are not stored directly by Givee®.

3. How we collect information

Information may be collected when an entity registers for Givee®, a user creates or accesses an account, a transaction is completed, a receipt is requested, a person participates in a raffle, prize draw, campaign, flow, volunteer activity or form, communications are sent or received, a dashboard or integration is used, or data is provided by an entity, user, payment provider, communication provider or integration partner.

4. How we use information

  • provide, operate, secure, administer, evidence and improve the platform
  • enable transactions, receipts, raffles, prize draws, campaigns, flows and communications
  • support entity access through the Control Centre and Intelligence Dashboard
  • process authentication, OTP and account access
  • provide reporting, exports, analytics and operational insights
  • support customer, donor, supporter and volunteer engagement
  • prevent fraud, misuse and security incidents
  • resolve disputes and support payment reconciliation
  • comply with legal, regulatory, tax, accounting and audit obligations
  • manage support, procurement, risk and compliance requests
  • improve platform functionality and develop new services

5. Data storage and processing locations

Core Givee® platform infrastructure is operated using secure cloud services. For registered entities and users in markets where Givee® offers local or regional hosting arrangements, additional data residency terms may apply through a separate legal pack, data sharing agreement or enterprise agreement.

Some third-party providers used by Givee®, including payment, communication, monitoring, analytics or operational providers, may process certain data outside the country where the entity or user is located. By using Givee®, you acknowledge that personal information may be processed in countries other than your own, subject to applicable law and the safeguards described in these Legal & Terms.

6. Data sharing

  • the registered entity connected to the relevant activity
  • Stripe or another approved payment provider
  • SMS, email and OTP communication providers
  • infrastructure or operational providers
  • CRM, fundraising platform or integration providers where enabled by the entity
  • professional advisers, insurers, auditors or legal representatives where required
  • regulators, authorities or law enforcement where required or permitted by law

Givee® provides relevant transaction, customer, supporter, raffle, prize draw, campaign, flow and platform activity data to registered entities under Givee®'s data sharing terms and applicable consent/privacy settings. Once a registered entity accesses, exports or uses data outside Givee®, the entity is responsible for its lawful handling, storage, security, use, communications, retention, deletion and onward disclosure. Givee® does not sell personal information.

7. Data security

  • encryption in transit and at rest within Givee-controlled systems
  • passwordless OTP-based platform authentication where applicable
  • no storage of user passwords for passwordless authentication flows
  • role-based access controls and least-privilege access
  • authenticated platform access and purpose-limited internal access
  • monitoring and logging where appropriate
  • separation of payment card handling through Stripe or other approved payment providers
  • controlled use of third-party providers
  • incident assessment and response processes

No system can guarantee absolute security.

8. Access, correction and privacy rights

Individuals may request access to, or correction of, personal information held by Givee® by contacting team@givee.app. Depending on where you are located, you may also have rights to request deletion, restriction, objection, portability, withdrawal of consent or other privacy rights under applicable law. Givee® may need to verify identity before responding.

9. Deletion and account closure

Individuals may request deletion, restriction or account closure by following the Delete Account process below or contacting team@givee.app. Some information may need to be retained where required or permitted by law, including financial, transaction, tax, audit, security, fraud-prevention, raffle, prize draw, receipt, dispute and compliance records.

10. Data retention

Givee® retains data for as long as reasonably necessary to provide, operate, secure, evidence, administer and improve the platform; comply with legal obligations; resolve disputes; prevent fraud or misuse; maintain financial and audit records; and satisfy operational, tax, accounting and compliance requirements. Where data is no longer required, Givee® may delete, archive, restrict or de-identify it depending on the nature of the data and applicable legal, operational or compliance requirements.

11. Communications and consent

Givee® may send or facilitate SMS, email, OTP, receipt, service, support, security, reporting, thank-you, volunteer, raffle, prize draw or other communications. Users and entities may have rights to opt out of certain communications. Some transactional, security, receipt, legal or service messages may still be required.

Registered entities are responsible for ensuring that communications they initiate or enable through Givee® comply with applicable consent, privacy, data protection, anti-spam and electronic messaging laws.

12. Data breaches and security incidents

If Givee® becomes aware of a suspected data breach or security incident, Givee® will take reasonable steps to assess, contain, investigate, mitigate and respond to the incident. Where notification is required under applicable privacy, data protection or breach-notification laws, Givee® will notify affected individuals, entities, regulators or authorities as required.

13. Complaints

Privacy questions or complaints may be directed to team@givee.app. Givee® will take reasonable steps to review and respond to privacy complaints. Depending on where you are located, you may have the right to contact a local privacy, data protection, consumer or other regulator.

14. Updates to this Privacy Policy

Givee® may update this Privacy Policy from time to time. The latest version will be available on the Givee® website.

Delete Account

1. Account deletion requests

Users may request deletion or closure of their Givee® account by contacting team@givee.app. Where account deletion is available through the Givee® app or dashboard, users may also follow the in-app or dashboard deletion process.

2. Verification

Givee® may need to verify the identity of the requesting person before processing an account deletion, restriction or access request.

3. What may be deleted

Givee® may delete, restrict, archive or de-identify account information where it is no longer required and where deletion is permitted by law.

  • payment reconciliation records
  • raffle tickets, entries, draw records and winner records
  • prize draw and promotional game records
  • tax, accounting, audit and compliance records
  • security, fraud-prevention and dispute records
  • records required to evidence platform activity
  • information required to protect legal rights or comply with legal obligations

5. Entity-held data

Where a registered entity has already accessed, exported or used data outside Givee®, that entity is responsible for handling deletion, correction, restriction or consent requests relating to its own copies of that data.

Child Safety Standards

1. Purpose

Givee® is intended to be used by registered entities and users in a lawful, safe and responsible manner. Some registered entities using Givee® may work with children, young people, families, schools, charities, community groups, hospitals, sporting organisations, religious organisations, youth-focused programs or other activities involving minors.

2. Givee® role

Givee® provides technology, payment enablement, customer engagement, communications and platform infrastructure. Givee® does not supervise children, run child-facing programs on behalf of entities, provide child-care services, verify the suitability of entity staff or volunteers, or take responsibility for entity-run programs.

3. Entity responsibility

  • complying with child safety, child protection, safeguarding, privacy, data protection and consent requirements that apply to their activities
  • ensuring staff, volunteers, contractors and representatives are appropriately screened and trained where required
  • ensuring content, campaigns, communications and activities involving children are lawful, appropriate and safe
  • obtaining parental, guardian, school or other required consents where required
  • handling images, names, stories and personal information of children in accordance with law and ethical practice

4. Prohibited conduct

  • exploit, harm, abuse, groom, harass or endanger children
  • collect children's personal information unlawfully
  • publish or distribute inappropriate child-related content
  • misrepresent child-related campaigns or causes
  • bypass required consent, screening or safeguarding obligations

5. Reporting concerns

Concerns about child safety misuse of Givee® may be reported to team@givee.app. Givee® may suspend or restrict access where child safety risk, unlawful conduct or misuse is suspected.

Accessibility Statement

Givee® is committed to improving accessibility and usability across its website, platform, apps, dashboards and user experiences.

3. Limitations

4. Feedback

Accessibility feedback may be sent to team@givee.app. Please include details of the page, feature, device, browser, assistive technology and issue where possible.

Acceptable Use

Users and registered entities must not use Givee® to:

  • conduct unlawful, misleading, fraudulent or deceptive activity
  • breach fundraising, raffle, promotional game, payment, tax, privacy, data protection, anti-spam, consumer, sanctions, child safety or other applicable laws
  • collect, use or disclose personal information without a lawful basis
  • send spam or unauthorised communications
  • interfere with platform security or availability
  • attempt unauthorised access
  • upload or distribute malicious code
  • impersonate another person or entity
  • misrepresent campaigns, causes, prizes, products, services or payment purposes
  • use Givee® for prohibited, harmful or high-risk goods, services or activities unless expressly approved by Givee® and lawful in all applicable jurisdictions

Givee® may suspend, restrict or terminate access where misuse is suspected.
